Please read these Terms carefully before using Acre. They include important information about beta access, market information, user responsibilities, warranty disclaimers, and limits on liability. Our Privacy Policy is part of these Terms.
1. Acceptance of these Terms
These Terms of Service ("Terms") are an agreement between you and Acre ("Acre," "we," "us," or "our") and govern your access to and use of Acre websites, mobile applications, beta programs, support channels, and related products and services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
If you use the Services on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.
2. Eligibility
You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with permission from a parent or legal guardian who agrees to these Terms on your behalf.
Certain features may have a higher minimum age or additional eligibility, identity, geographic, financial, or regulatory requirements. Any feature involving a payment, transaction, position, prize, or other regulated activity is available only to users who are at least 18 and otherwise eligible under applicable law and any feature-specific terms.
3. Accounts and access
You agree to provide accurate, current information, keep your login credentials and devices secure, and promptly notify us if you suspect unauthorized access to your account. You are responsible for activity conducted through your account to the extent permitted by law.
Beta invitations and account access are personal to you unless Acre expressly permits a transfer. We may require you to verify information or complete additional steps before accessing particular features.
4. Beta service
Acre is currently a beta service. Beta features may be incomplete, contain errors, change without notice, or be suspended or discontinued. Availability during a beta does not guarantee that a feature will be offered generally or on any particular terms.
You should not rely on the Services as the sole source for decisions about a home, real estate market, investment, transaction, or other material matter. Please keep independent copies of information you need and independently verify important information.
5. License to use Acre
Subject to these Terms, Acre grants you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Services for their intended purposes. The Services are licensed, not sold, and Acre and its licensors reserve all rights not expressly granted to you.
You may not copy, sell, sublicense, distribute, modify, create derivative works from, reverse engineer, decompile, scrape, or attempt to extract source code or underlying data from the Services, except to the extent a restriction is prohibited by applicable law or permitted by applicable open-source licenses.
6. Market information and predictions
The Services may display property information, estimates, forecasts, predictions, market signals, third-party data, and user-generated inputs. This information may be delayed, incomplete, inaccurate, or unavailable and may change as new information becomes available.
Predictions and market signals are opinions or model outputs, not statements of fact or guarantees of future value, sale price, liquidity, or outcome. Acre does not guarantee the accuracy, completeness, timeliness, or availability of any property, market, or prediction data.
7. No professional advice
The Services are provided for general informational and product-use purposes. Acre does not provide investment, financial, legal, tax, accounting, appraisal, brokerage, lending, or other professional advice through the Services, and no fiduciary, advisory, brokerage, or agency relationship is created by your use of the Services.
Nothing in the Services is an offer, solicitation, recommendation, or guarantee to buy, sell, finance, or enter into any transaction. You are responsible for evaluating information, obtaining advice from qualified professionals, and deciding whether any action is appropriate for you.
8. Transactional or regulated features
If Acre makes a paid, transactional, real-money, prize-based, or otherwise regulated feature available, that feature may be subject to additional terms, risk disclosures, eligibility checks, identity verification, geographic limits, funding rules, fees, and legal restrictions presented before use. Those additional terms control if they conflict with these Terms for that feature.
Access to general Acre content does not mean you are eligible for any transactional or regulated feature. Acre may restrict, delay, reject, reverse, or report activity when reasonably necessary to comply with law, protect users, prevent fraud or abuse, or enforce applicable rules. Any transaction or position may involve substantial risk, including loss of the entire amount committed.
9. Your content and feedback
You retain ownership of content you submit to the Services. You grant Acre a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, display, and use that content only as reasonably necessary to operate, secure, provide, and improve the Services, comply with law, and as otherwise described in our Privacy Policy. This license ends when the content is deleted from our active systems, subject to reasonable backup, legal, and recordkeeping needs.
If you voluntarily provide product ideas or feedback, you agree that Acre may use them without restriction or compensation to you. Do not submit content you do not have the right to provide.
10. Acceptable use
You may not use the Services to violate law or another person's rights; misrepresent your identity or eligibility; manipulate, disrupt, overload, or probe the Services; introduce malware; evade access or geographic controls; automate access without permission; obtain another user's information; interfere with market integrity; or facilitate fraud, harassment, abuse, or other harmful conduct.
You may not use Acre content, data, or outputs to build or train a competing product or model without our written permission. We may investigate suspected violations and cooperate with lawful requests from authorities.
11. Acre property
The Services, including Acre's software, designs, text, graphics, logos, trademarks, market presentation, and other content, are owned by Acre or its licensors and are protected by intellectual property and other laws. These Terms do not grant you any right to use Acre names, marks, or branding except as necessary to use the Services.
12. Third-party services and data
The Services may depend on or link to third-party products, data, maps, listings, authentication, payments, app stores, or websites. Third parties may apply their own terms and privacy policies. Acre does not control and is not responsible for third-party services or for the accuracy or availability of third-party data.
You agree to comply with applicable third-party terms when using the Services, including your device, network, and app-store provider's terms.
13. Apple App Store terms
If you obtained the Acre iOS application through Apple's App Store, Apple's Standard Licensed Application End User License Agreement (the "Standard EULA") also governs your license to the application unless Acre provides a custom end-user license agreement through App Store Connect. If these Terms conflict with the Standard EULA regarding the license to the iOS application, the Standard EULA controls.
These Terms are between you and Acre, not Apple. Acre, not Apple, is responsible for the Services and their content, support, and claims relating to the Services, except for responsibilities Apple has under the Standard EULA or applicable law. Apple and its subsidiaries are intended third-party beneficiaries of this section and may enforce it.

14. Fees and purchases
Acre will disclose applicable prices, fees, and payment terms before you complete a purchase or paid activity. Purchases processed by Apple are also subject to Apple's payment and refund terms. Except as required by law or the applicable app-store rules, charges are non-refundable once the associated service has been provided.
15. Privacy
Our Privacy Policy explains how Acre collects, uses, and shares information about you. By using the Services, you acknowledge the practices described in that policy.

16. Suspension and termination
You may stop using the Services at any time. You may request account deletion by contacting support. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, used the Services fraudulently or harmfully, or if needed to protect Acre, users, or third parties.
Provisions that by their nature should survive termination will survive, including provisions concerning ownership, disclaimers, limitations of liability, disputes, and general terms.
17. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." ACRE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT.
Acre does not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that defects or data errors will be corrected. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
18. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACRE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITY, OR EXPECTED SAVINGS, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACRE'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID ACRE FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations do not apply to liability that cannot be limited or excluded under applicable law.
19. Disputes
Before filing a formal claim, please contact support@acremarkets.com and provide a brief description of the issue so we can try to resolve it informally. Nothing in these Terms limits rights or remedies that cannot be waived under applicable law.
20. Changes to the Services or Terms
We may modify the Services and these Terms from time to time. The Last updated date above shows when these Terms were most recently revised. If a change is material, we will provide notice as required by law. Your continued use after updated Terms become effective means you accept them; if you do not agree, you must stop using the Services.
21. General terms
These Terms, the Privacy Policy, and any applicable feature-specific terms form the agreement between you and Acre regarding the Services. If one provision is unenforceable, the remaining provisions remain in effect. Acre's failure to enforce a provision is not a waiver. You may not assign these Terms without Acre's written consent; Acre may assign them in connection with a merger, acquisition, reorganization, or sale of assets, subject to applicable law.
